TERMS AND CONDITIONS FOR THE USE OF NURSE CONNECT APP AND WWW.THEAPPCONNECT.COM  

  1. Interpretation

The following definitions and rules of interpretation apply in these Conditions. 

  • Definitions:
  • Conditions: these terms and conditions as amended from time to time in accordance with these conditions. 

Contract: the agreement reached between the Supplier and You for the use of the App and/or Site which is governed by these Conditions. 

App: the Supplier’s App which operates on Apple and Android systems called ‘Nurse Connect App’. 

Site: the Supplier’s website – www.theaapconnect.com    

  • Supplier: Connect App Limited registered in England and Wales with company number 14652970

You/r: An individual who has entered into the Contract with the Supplier to use the Supplier’s App and/or Site

  • Interpretation:
  • Any words following the terms including, include, in particular, for example or any similar expression, shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
  • A reference to writing or written does include email.
  1. THE APP AND SITE
  • The information and services available on the App and/or Site are provided for the sole purpose of allowing you to review and apply for vacancies. You may use, print and download information from the App and/or Site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the App and/or Site. All copyright, database rights and other intellectual property rights in the App and/or Site and the material available on the App and/or Site belongs to the Supplier. You agree not to deep-link and/or frame the App and/or Site unless specifically authorised by the Supplier to do so.
  • The Supplier allows You to access and use the App and/or Site subject to these Conditions. Should You use this service for any purpose other than those specifically stated in these Conditions shall immediately be banned from using this App and Site.
  • The Supplier will try to ensure continuous availability of the App and Site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. The Supplier may additionally alter the design and specification of the App and/or Site at any time.
  • The Supplier does not introduce nor supply or directly introduce You to employers (or vice versa). You must ensure your suitability for any role advertised.
  • You agree that You shall not use the App and/or Site to transmit or knowingly or recklessly receive (or knowingly or recklessly authorise or permit any other person to receive or transmit) material which is obscene, threatening, menacing, offensive, defamatory, abusive, untrue, in breach of confidence, in breach of any intellectual property right (including copyright) or which may cause anxiety to others including racist or sexist content or material which otherwise violates any applicable law or regulation or code, or which makes excessive demands for bandwidth to the extent it has a detrimental effect on the operation of the App and/or Site or contains any virus or which may otherwise impair or harm the Supplier’s computer systems or any third party computer system.
  • Save to the extent possible by law the Supplier does not warrant that the App and/or Site or will operate without error or that the App and/or Site or services on the App are free from infection by viruses or anything else which has contaminating or destructive properties and the Supplier shall have no liability in respect thereof.
  • Save to the extent required by law, no representations, warranties or terms of any kind are made in respect of the App and/or Site its contents (including, without limitation, any views or comment made). All information and/or data included in and/or on the APP and/or Site, or other listings or information retrieval service made available on or by the APP and/or Site and/or the services provided on the App and/or Site has been so made available for guidance only. In addition, the Supplier makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in the App and/or Site. The information contained in the App and/or Site may contain technical inaccuracies or typographical errors.
  • The App and/or Site contains links to third party Supplier websites. These links are provided solely as a convenience to you and not as an endorsement by the Supplier of the contents on such third-party supplier. The Supplier is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party sites. If You decide to access linked third-party sites, You do so at Your own risk FURTHERMORE You acknowledge that the Supplier is not responsible for third party content on the App and/or Site and that the Supplier cannot ensure that material presented on the internet is legal. The Supplier will not limit access to material unless notified that it is illegal. In particular, You acknowledge that the Supplier is not responsible for and does not monitor the content of job postings provided by third parties on the App and/or Site. However, the Supplier shall have the right to remove any postings, materials or other items on the App and/or Site which it believes may be illegal or which it determines to be inappropriate.
  • You agree to defend, indemnify, and hold harmless the Supplier, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation all legal and accounting fees, alleging or resulting from (i) any content or other material You provide to the App and/or Site (ii) Your use of any content on the App and/or Site, or (iii) Your breach of these Conditions.
  • These Conditions will remain in full force and effect while You are a user of the App and/or Site. The Supplier reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of Your user content from the App and/or Site and immediate termination of Your registration with, or ability to access the, App and/or Site and/or any other services provided to You by the Supplier, upon any breach by you of these Conditions or if the Supplier is unable to verify or authenticate any information You submit to the App and/or Site. Even after You are no longer a user of the App and/or Site, certain provisions of these Conditions will remain in effect. The Supplier may terminate, suspend or deny you access to the App and/or Site immediately for any reason without incurring any liability whatsoever to You.
  • Where You are asked to complete a registration form the personal details that you provide must be true, accurate and complete. You agree to notify us of any changes to any details you provide to us.
  • Your personal data will be collected and processed by the Supplier in accordance with its privacy policy. You hereby agree to these terms in our privacy policy by your agreement to these Conditions. A copy of our privacy policy is available upon request.
  • Failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.
  • If any part of these Conditions or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.
  1. FURTHER TERMS FOR YOUR USE OF THE APP AND/OR THE SITE
  • You acknowledge and agree that You are solely responsible for the form, content and accuracy of any CV or material contained therein placed by You on the App and/or the Site. You should be aware (subject to the contact details you provide) that You may be contacted directly by potential employers by (but not limited to) email, post, SMS, Whatsapp or by telephone.
  • The Supplier reserves the right to offer third party services and products to You based on the preferences that you identify in Your registration and at any time thereafter or You have agreed to receive, such offers may be made by the Supplier or by third parties.
  • Supplier do not guarantee that by subscribing to the App and/or Site that it will enhance Your profile or you will secure a job. The App and/or Site is a tool that will enhance Your visibility to potential employers and enable You to apply for jobs by email.
  • The Supplier does not discriminate against anyone registered to or using the App and/or Site. The Supplier tries to ensure that all possible measures are taken to prevent any vacancies advertised or searches do not discriminate against age, disabilities, gender or race. The search tools in place on the App and/or Site do not have the functionality to exclude individual with disabilities. It is down to the users themselves to ensure they comply with discrimination laws.
  • Services and information provided on the App and/or Site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither the Supplier nor third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the App and/or Site in circumstances which may result in loss or damage.
  • The Supplier’s, and the liability of the Supplier’s third party suppliers, for any loss or damage suffered by You as the result of your use of this App and/or Site is fully excluded as permitted to the full extent of the law (save for fraud, death or personal injury) and for the avoidance of doubt excludes (but not limited to) any loss of future earnings, profit or prospects or any consequential or speculative loss.
  • You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your account or Your account is terminated, all Your account information from the App and/or the Site, including CVs, profiles, cover letters, saved jobs, questionnaires will be marked as deleted and will be deleted from the Supplier’s databases within a reasonable time period. Third parties may retain saved copies of Your Information.
  • The Supplier reserves the right to delete Your account and all of your information after a significant duration of inactivity or in the event that any of our terms have been breached by You.
  • By registering Your CV on the App and/or the Site You also agree that Supplier may also store and show Your CV and profile details, to potential employers.
  1. Termination
  • Without affecting any other right or remedy available, the Supplier may terminate Your use of the App and/or Site for any reason whatsoever. The Supplier will endeavour to do so (but is not required to) give You advance notice of their intention to terminate Your use of the App and/or Site but You accept that in some circumstances this will not be possible.
  1. General
  • Force majeure 

Neither party shall be in breach of the Contract nor liable for delay in performing, or failure to perform, any of its obligations under the Contract if such delay or failure result from events, circumstances or causes beyond its reasonable control. 

  • Assignment and other dealings 
  • The Supplier may at any time assign, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any or all of its rights and obligations under these Conditions.
  • You shall not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any of its rights and obligations under the Contract without the prior written consent of the Supplier.
  • Entire agreement 
  • These Conditions constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
  • Each party acknowledges these Conditions, and neither party shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these Conditions.
  • Nothing in this clause shall limit or exclude any liability for fraud.
  • Variation 

Except as set out in these Conditions, no variation of these Conditions shall be effective unless it is in writing and signed by the parties (or their authorised representatives). The Supplier reserves the right to vary these conditions from time to time (including the services offered by the Supplier). Such changes shall either be notified to you by e-mail or posted on the App and/or Site via the logged in candidate or recruiter home pages. Changes in this manner shall be deemed to have been accepted if you continue to use the App and/or Site after a period of two days from the date of transmission of the e-mail or newsletter, or of posting on the App and/or Site, whichever occurs later. 

  • Waiver

A waiver of any right or remedy under the Contract or by law is only effective if given in writing and shall not be deemed a waiver of any subsequent right or remedy. A failure or delay by a party to exercise any right or remedy provided under the Contract or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under the Contract or by law shall prevent or restrict the further exercise of that or any other right or remedy.

  • Severance 

If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement. 

  • Third party rights 
  • Unless it expressly states otherwise, the Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
  • The rights of the parties to rescind or vary the Contract are not subject to the consent of any other person. 
  • Governing law 

The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales. 

  • Jurisdiction 

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.
